Chapter 14.3 – Regulatory classification CH / EU

Switzerland (CH)

European Union (EU)

The Swiss Federal Act is a legislative provision enacted by the Federal Assembly. In the hierarchy of norms, it stands between the constitution and the ordinance: the federal law concretizes the constitution and is in turn concretized by the ordinance.

The EU Regulation is a legal act of the European Union and is of general application. It is binding in all its parts and applies directly in every member state.

The CH ordinance is a legislative decree that is subordinate to the constitution and the law. It implements the statutory provisions and supplements and completes them.

The EU Directive is a legal act of the European Union and is binding for each Member State to which it is addressed. However, it must be converted into national law by the member states. The EU Directive leaves the choice of form and means to the national authorities.
